Affiliate Program Terms

These Affiliate Program Terms (the “Program Terms”) apply between you (the “Affiliate”, “you”) and the operator of Ghostex.ai (“Ghostex”, “we”, “us”). By applying to or taking part in the affiliate program (the “Program”), you agree to these Program Terms. Ghostex.ai is established at 15 Tamar Mepe Street, Kutaisi 4600, Georgia; notices can be sent to legal@ghostex.ai.

The Program Terms sit alongside our Terms of Service and Privacy policy, which continue to apply to every order, including orders placed by people you refer. If a specific commission or payment arrangement is agreed with you in writing, that arrangement and these Program Terms apply together; where they conflict, the written arrangement controls for the point it covers.

Program

The Ghostex.ai affiliate program described on the affiliate page and governed by these Program Terms.

Referral link

A link or code we issue to you, used to attribute swaps to your account.

Referred user

A person who reaches Ghostex.ai through your referral link and creates an order. Referred users never register an account.

Qualifying swap

An order from a referred user that completes and is delivered, and on which Ghostex keeps its fee.

Fee

The flat 0.48% charged on a swap, included in the quote, as described in the Terms of Service.

Commission

The share of the Fee on a qualifying swap that we pay you, at the rate agreed with you in writing.

To join the Program you must:

• be at least 18 years old, or the age of legal majority where you live if that is higher, and able to enter a binding agreement;
• not be a person or entity subject to sanctions that apply to you, and not act for one;
• promote Ghostex only where doing so is lawful, and follow the rules of any platform you use;
• provide accurate information about yourself and your channels when you apply.

We may accept or decline any application at our discretion, and we do not have to give a reason.

You join by email. Write to affiliate@ghostex.ai and tell us where and how you would promote Ghostex. If we accept you, we issue a referral link and confirm your Commission rate in writing.

There is no affiliate account to log into and no dashboard. The Program does not ask you or your audience to register, and it does not create any user account.

You earn a Commission on qualifying swaps, calculated as your agreed share of the Fee kept on each such swap.

• Completed swaps only. A Commission accrues when an order from a referred user completes and delivers. Refunded, expired, cancelled or reversed orders earn no Commission, because no Fee is kept on them.
• Your rate. We agree your Commission rate with you in writing before you start. We do not publish a fixed tier table, and rates may differ between partners.
• No cost to your audience. The Commission is paid from our share of the Fee. Referred users pay the same flat 0.48% fee, never more because they came through you.
• Adjustments. We may withhold or reverse a Commission linked to fraud, an error, a chargeback-style reversal, or activity that breaks these Program Terms.

Commissions are paid in cryptocurrency to an address you control. The asset, the payout schedule and any minimum payout threshold are set out in your written arrangement.

• You are responsible for giving us a correct payout address, on the correct network. Crypto transactions are irreversible, so a payout sent to an address you provided cannot be recalled.
• Network fees for sending a payout may be deducted from the amount, as stated in your arrangement.
• If a payout cannot be made because your address is missing or invalid, we will hold the Commission until you supply a valid address.

Swaps are attributed to you through the referral link we issue. Because Ghostex does not run advertising trackers or set marketing cookies, attribution is based on the referral parameter carried with the order and on our own order records. The exact method is described when you join.

Our records of qualifying swaps and Commissions are the reference for what is owed. Where our records and yours differ, we will review the difference in good faith. We do not collect identity information about referred users, so attribution is at the level of the order, not the person.

When you promote Ghostex, you must:

• describe the service honestly and keep to the facts, such as the flat 0.48% fee, the lack of accounts and KYC, and automatic refunds, without adding your own guarantees;
• not promise earnings, returns, profits or any specific outcome on our behalf, and not present crypto swaps as risk-free;
• use our name, logo and brand assets only as set out in our brand guidelines, and never in a way that suggests you are Ghostex or speak for it;
• make clear that you are an affiliate where the law or a platform requires that disclosure.

You are responsible for the content you publish and for the channels you use.

You must not, directly or indirectly:

• generate fake, automated or incentivised traffic or swaps, or refer yourself to earn Commission;
• bid on our brand terms in paid search, or run ads that imitate our site, in a way we have not approved;
• send spam, or promote Ghostex on channels that are illegal, deceptive or unsafe;
• make misleading claims about the service, or offer unauthorised rebates, cashback or bonuses in our name;
• promote the service for any use prohibited by our Terms of Service, or break any law that applies to you.

If we reasonably believe you have broken this section, we may withhold or reverse affected Commissions and end your participation.

You are responsible for following the laws, regulations and platform rules that apply to your promotion, including advertising, consumer and marketing rules and any required affiliate disclosure.

You are solely responsible for any taxes on the Commissions you receive. We do not provide tax advice, and Commissions are paid without withholding unless the law requires otherwise.

You take part in the Program as an independent party. Nothing in these Program Terms creates an employment, partnership, joint venture or agency relationship between you and Ghostex. You may not enter agreements or make commitments on our behalf, and you speak only for yourself.

Either of us may end your participation in the Program at any time, on notice by email. We may suspend or end it immediately if we reasonably believe you have broken these Program Terms or our Terms of Service.

When participation ends, you must stop using your referral link and our brand assets. Commissions already earned on qualifying swaps before the end date are paid under section 6, unless they are linked to fraud or a breach. No Commission is owed on activity after the end date.

The Program is provided on an “as is” and “as available” basis. We do not guarantee any level of traffic, conversion, volume or earnings, and past results do not predict future ones.

To the fullest extent the law allows, and except where liability cannot be limited, we are not liable for indirect or consequential loss, or for lost profits or lost earnings, arising from the Program. Where we are found liable, our total liability under these Program Terms is limited to the Commissions we paid, or should have paid, you in the three months before the event giving rise to the claim. Nothing in this section limits liability that cannot be limited by law.

We may update these Program Terms and the Program itself, including Commission rates, by giving you reasonable notice. Changes to a rate apply to swaps after the change takes effect. If you keep taking part after a change, you accept the updated Program Terms. The current version, with its date, is always on this page.

Questions about the Program or these Program Terms can be sent by email. We will never ask for your seed phrase, private keys or identity documents.
